| SUFFERN,
NY, August 7, 2001 - Ositech Communications, Inc., Guelph,
ON Canada (Ositech), has been named in a patent infringement
lawsuit by Acticon Technologies LLC (Acticon), a wholly
owned subsidiary of General Patent Corporation International
(GPCI). The suit seeks to enforce four of Acticon's patents
that cover specific aspects of PC Card modems, other PCMCIA
form-factor communications and IO devices, and smart connectors.
The suit was filed in the United States District Court
for the Southern District of New York.
"Litigation is always the last option for us,"
said Paul Lerner, GPCI's general counsel and senior
vice president. "However, Ositech was notified
of the infringement in April of 2000 and we feel that
we have exhausted our earnest efforts to resolve this
matter." He added, "We intend to proceed resolutely
with this law suit in order to enforce our proprietary
rights."
GPCI has successfully enforced these patents on behalf
of its subsidiary, Acticon, through litigation in five
separate courts. The defendants in these litigations
included IBM, Smart Modular Technologies, Motorola,
U.S. Robotics Corp. (now 3Com), Xircom, Boca Research,
and many other companies. All of the defendants in these
litigations have taken a license under the patents.
"GPCI's licensing and enforcement efforts have
resulted in the overwhelming acceptance of these patents
by more than 85% of the modem industry," said Dr.
Steven Farago, Acticon's chief technologist and the
named inventor on three of the four patents-in-suit.
